SAFARI TENT GLAMPING RENTAL AGREEMENT, RULES & REGULATIONS & WAIVER OF LIABILITY
By reserving a glampsite, you, the Glamper(s), are agreeing to this Safari Tent Glamping RENTAL AGREEMENT, RULES & REGULATIONS specified herein, including the fees and cancellation policy of Love Cedar Point Inc (the Company). and the Campground Rules & Regulations of Suffolk County Parks (the County) and the Liability Waiver and Release of Liability below. Glampers understand that Love Cedar Point, Inc. is licensed by the County to offer camp store and safari tent glamping services at Cedar Point County Park (the Park). The glamping area (Glamping Meadow) operated by the Company is a separate area from the campsites operated at the Park by the County. Rules and Regulations are subject to change after reservations are made. Glamping Rules & Regulations can be found here and our website, www.loveCedarPt.com/rules . Campground Rules and Regulations of the County can be found here: https://www.suffolkcountyny.gov/Departments/Parks/Doing-Business/Rules-and-Regulations/Campground-Rules-and-Regulations . Suffolk County Park Rangers patrol Cedar Point County Park. Violation of any safari tent glamping or campground rule or regulation is grounds for eviction.
RESERVATIONS
- Glampers can make reservations at our camp store and online reservation engine and channels including but not limited to AirBnB, Booking.com, Vrbo, Google Vacation Rentals. Rates are published there and could vary across booking channels due to the varying booking fees of the channels.
- Reservations must be made by and in the name of a person who is at least 18 years of age.
- Walk-up Glampers may reserve site(s) on the same day at the camp store, availability of a site is not guaranteed and is first-come first-serve.
- Both Residents and Non-Residents of Suffolk County may make reservations online once reservations for the season open (our goal will be January 1 every subsequent season). The Company will announce in advance the online reservation opening date via our newsletter and on social media. Glampers can register for the newsletter on www.loveCedarPt.com and can opt-out at any time.
- Safari tent glamping operating season dates may vary with camping dates of the County but generally starting the Friday of Memorial Day weekend and ending the Monday of Columbus Day Weekend. Operating dates may vary in the years to come. Safari Tent Glamping is not offered by the Company at the Park outside the posted operating dates.
- Glampers may not enter safari tents without a valid reservation for the date and tent specified. Camping or Glamping in a site without the appropriate reservations or permits is illegal.
- Glampers reserve a specific safari tent site and cannot change sites without checking with the Camp Store first for reassignment if availability.
- Reservations that include the Saturday, have a two (2) night minimum stay requirement unless otherwise established.
- Reservations that include the Saturday or Sunday on a holiday weekend have a three (3) night minimum stay requirement unless otherwise established. This would include the Memorial Day, Juneteenth, 4th of July, Labor Day and Columbus Day Holidays.
- Reservations are limited to a fourteen (14) night maximum stay unless otherwise established.
ARRIVALS / DEPARTURES
- Check-in at the Cedar Point Camp Store. Arrival at the Safari Tent without first checking-in the camp store is not permitted. Giving your information to the Park attendant at the Park entrance gate is not considered check-in for Glamping.
- Check-in is generally between 4:00 PM and 6:00 PM, or later if store hours permit, on the first day of your reservation.
- Earlier check-in times are possible if the safari tent is ready for you, but you must check with the camp store first before arriving at the Safari Tent.
- If you cannot check-in by closing time of the Camp Store on the day of your arrival, contact the camp store in advance to make arrangements.
- If a reservation is not cancelled and the Glamper does not check-in or contact the Company with an anticipated arrival time and date by 9:00 pm on their reserved check-in date, they are considered a no-show. The Company will try to contact you. There Are No Refunds For No Show Reservations.
- There may be times when your safari tent is not ready by 4:00 PM for check-in.
- Parking is only permitted in areas designated as Parking for Safari Tent Camping.
- Check-out is by 11:00 A.M. on the last day of your reservation.
- If the Glamper is not vacated from the glamp site by check-out time, they are subject to a ‘late check out fee.’ Late check-out requests must be approved at the Camp Store.
- To extend your stay, please check with the camp store. We are happy to accommodate if there is availability but we cannot guarantee any.
RESTROOMS AND SHOWERS
- Restrooms, showers and a dish washing station are located in the county park building near the road.
- One (1) Bath Towel per guest will be provided.
- Hotel size soap, shampoo and conditioner are provided.
- Two (2) Rechargeable LED Lanterns are provided for each safari tent for use for bathroom trips after dark and to light the safari tent after dark. Usually, the lanterns we provide have a USB charging port for your devices.
- Water spickets are provided in the glamping area by the County. Glampers should bring appropriate containers if they choose to use this water.
PROHIBITED ITEMS
- Guests must not cook or allow any open flames, flammable devices within or near the safari tents or on the deck/platform, except in the designated BBQ grills and fire rings provided.
- Open ground fires are prohibited. Use only charcoal in grills provided, or you may bring a camp stove. All campfires must in approved fire rings/containers with solid steel bottoms only. Fire must be completely extinguished with water before leaving. IMPORTANT Covering the fire with sand does not extinguish the fire. Instead, it insulates the hot coals and fills the pits with hot sand. Dispose of coals in proper metal receptacles.
- Smoking is prohibited within the safari tents or on the deck or platform.
- Flammable liquids, fuel or propane is prohibited within the safari tents or on the decks/platforms.
- Firearms are not permitted.
- Fireworks are not permitted.
- Generators are not permitted in the Glamping Meadow.
- Trenching, digging, or leveling platforms and glamping sites is prohibited.
- The Glamper is responsible for preventing any wastewater from discharging onto the ground.
- Littering is prohibited. Dispose of all trash & recyclables in appropriate receptacles, wash dishes only at dishwashing station, and leave your site clean.
- Vehicles are not permitted in the Glamping Meadow except for authorized Company or Park vehicles.
PETS
- It is the pet owner’s responsibility to ensure all pets staying/visiting the Park, the County campground and the Glamping Meadow are inoculated per local and state regulations.
- Proof of inoculations for any pets that will be staying on site may be requested at any time.
- Proof includes Rabies Certificate or tag dated for current year
- Only domesticated animals are permitted in Suffolk County Parks.
- Pets are not permitted in bathrooms, picnic areas or areas where food is served to the public.
- Pets must be on no more than a 6’ leash and under owners’ control at all times.
- Pets are never to be left unattended on county property.
- Two (2) pets per glamp site are permitted for the daily pet fee.
- Owners are responsible for the proper disposal of pet waste.
- Pets must not disturb other glampers, staff or visitors of the Park.
OCCUPANCY
- Single Glamping Sites (numbered with S prefix) which are the 12×14 ft safari tents) have a single Queen bed and sleep two persons as standard. Glampers, for an additional fee, may upgrade up to two more cots for a total of four (4) adults and children.
- Double Glamping Sites (numbered with D prefix) which are the 12×18 ft safari tents) have two Queen beds and sleep four persons as standard. Glampers, for an additional fee, may upgrade up to two more cots for a total of six (6) adults and children.
- Guests may visit Glampers in the Glamping Meadow between the hours of 8 am-10 pm.
- Vehicles are not permitted in the Glamping Meadow. All vehicles must park in the designated parking for Glamping.
- Up to two vehicles per glamp site may be permitted.
- Additional vehicle(s) with purchased additional parking pass from the Park must park in location specified by the Park.
- Quiet hours are observed from 10:00 pm each night until 8:00 am the following morning. Loud noise and audio devices or guests are not permitted during quiet hours.
- Groups of glampers under 18 years of age must have at least one (1) member Glamper over 18 years of age.
- Minors may not be left unattended at any time.
- Please keep our campsite clean, place trash in provided receptacles.
DAMAGE, HOLD HARMLESS, RESERVATION CHANGE & CANCELLATION POLICY
- Changes to and cancellations of reservations are permitted at three (3) weeks or more in time prior to the check-in time of the reservation for a change or cancellation fee that varies from 3% of the reservation refund to $9 depending on the booking channel. Between three (3) weeks and ten (10) days of the check-in time of the reservation a refund of up to 50% of the reservation total may be refunded for a cancellation. Canceling or modifying reservations may be performed online through the online booking channel used or by contacting the camp store. Cancellation policy may vary across booking channels such as our booking engine, AirBnB, Booking.com, Reserve America, Expedia, VRBO, Google Vacation Rentals, Hotels.com, etc.
- Glampers agree that reservations are non-refundable or partially refunded as specified above, nor can dates be modified, within three (3) weeks of the arrival date. Only the Camp Store can waive this timeframe based on special situations at the sole discretion of the manager of the Camp Store and based on availability and the Company’s ability to resell the cancelled or modified accommodation.
- If a reservation is not cancelled and the Glamper does not check-in or contact the Company with an anticipated arrival date by 9:00 PM on their reserved check-in date, they are considered a no-show. No-show sites will become available for booking to others on a first-come, first-serve basis. There Are No Refunds for No Show Reservations.
- Glampers agree that they are not entitled to a refund due to rain, wind, heat or general weather or environmental conditions that may be uncomfortable, or conditions where nature, animals, insects or pests are present, other than hazardous or severe weather as described below.
- Glampers understands that tents are temporary structures designed to provide limited protection from weather conditions, primarily sun and rain; however there may be situations, particularly those involving strong winds, in which the tents will not provide protection and may even be damaged or blown over. Evacuation of tents to avoid possible injury is recommended when severe weather threatens the area where the tents are erected. Glampers must leave the tents and not seek shelter in tents during such conditions. It is best to evacuate when in doubt. Glamper also understands that tents are not guaranteed to be 100% waterproof and may leak during heavy rain.
- In the event of circumstances out of the control of the Glampers (i.e. extreme or severe weather, service malfunction, repairs, as determined by the Company or an evacuation by local authorities or the Park Administration) the Company and the Park Administration will assist in relocating the Glampers. If no other locations are available within a reasonable time or distance a refund may be provided by the Company to the Glampers at the sole discretion of the Company.
- All photos, diagrams, descriptive materials and specifications depicted on our web site are for the sole purpose of providing a general description and level of quality of the goods and services being offered to assist with your purchasing decision and are subject to change based upon availability.
- A damage deposit form is required to be completed at check-in. Glampers are responsible for damage to the safari tents, furniture and equipment beyond normal wear & tear. Guest must inspect and assess the condition of all goods upon taking possession and bring to the attention of the Camp Store any goods that are less than good condition.
- Rechargeable LED Lanterns and Rechargeable Fans, if provided, must be returned. Failure to do so will result in Glampers being charged for their replacement cost.
- The Company is not liable for injuries or damage to persons or property caused by fire, lightning, windstorm, rain, cyclone, tornado, hail, explosion, weather event or any other acts of God.
- Glampers are responsible for loss or damage to rental goods in case of Fire, Theft, or other hazard, regardless of cause or fault from the point in time from which physical possession is taken of the rental goods from the Company to the point in time which the Company takes possession back of the goods.
- Equipment, lost, stolen, or damaged will be the responsibility of the Glamper at its replacement cost.
- Glamper will take all necessary precautions regarding the items rented and protect all persons and property from injury or damage.
- Glampers agree that the items will be used only for the purpose for which the items were manufactured and intended. (e.g., no standing on any beds, tables or chairs).
- Glampers agree to indemnify, defend and hold harmless the Company, including, but not limited to, attorney’s fees and costs, from and against any and all liability claims and judgments of every kind and nature including, but not limited to, injuries or death to persons and damage to property, arising out of the use, maintenance, operation, possession, or rental of the items rented.
- Additionally, Glampers understand the inherent risks and acknowledge and agree to the Liability Waiver and Release of Liability below.
- Glamper agrees to pay the Company all costs and expenses and reasonable attorney’s fees in any action brought to recover the rented merchandise, collect rentals or damages, or in which the Company may become a party by reason of this Agreement.
VIOLATIONS
- You have agreed to follow these rules at the time of booking, please keep in mind these rules are in place for your safety.
- Violation of any safari tent glamping or campground rule is grounds for eviction.
LIABILITY WAIVER and RELEASE OF LIABILITY
WARNING: THERE ARE INHERENT RISKS OF INJURY AND ILLNESS CAMPING, GLAMPING, SWIMMING, WALKING, HIKING, AND BEING ACTIVE IN THE OUTDOORS.
THIS IS A RELEASE OF LIABILITY—YOU MUST READ AND FULLY UNDERSTAND THIS UPON RESERVING. IF YOU ARE UNDER 18, YOUR PARENT OR LEGAL GUARDIAN MUST MAKE THE RESERVATION AND AGREE TO THIS WAIVER. BY RESERVING OR BOOKING A RESERVATION, YOU, THE GLAMPER, ACKNOWLEDGE AND AGREE TO THIS WAIVER AND THE RULES AND POLICES ABOVE.
I, THE GLAMPER, for myself and on behalf of my/our heirs, assigns, personal representatives, and next of kin, hereby acknowledge that I voluntarily have booked a glamping reservation. I understand that camping and glamping in the outdoors involves known and unknown risks of injury to me and other people, which includes but is not limited to death, disability, injury, illness or disease, physical or mental damage, or other injuries, as well as damage to my equipment and personal property. Some of these risks include the risks inherent in being outdoors such as tripping and falling on uneven ground, roots, rocky ground, falling tree limbs, wind and flying objects, darkness, sandy cliffs and bluffs, rocks and boulders, campfire related burns or harm, swimming or bathing in open water, wet floors and decking, glamping equipment and furnishings, contact with wildlife, insects, bees, wasps, mosquitoes, ticks, spiders, and latent or apparent defects or conditions in equipment or property, and passive or active negligent acts of myself, Love Cedar Point Inc., staff, the County, promoters, officials, advertisers, booking agents/channels/Online Travel Agencies (OTAs) and property owners. By reserving a glampsite(s), I acknowledge that I am aware of the possibility of sustaining an injury, bite or otherwise. I understand that the above list of risks is not complete or exhaustive and that those and other risks known or unknown, anticipated or unanticipated may also result in injury, death, illness, or disease to myself or my property or other third parties. I voluntarily agree and promise to accept and assume responsibilities, and injuries, death, illness, disease, or damage to myself or my property arising from my participation in Glamping. I further understand that Love Cedar Point Inc., OTAs & the County assumes no liability for loss, damage, or any kind of injury sustained by myself or my property while participating in any program or lessons provided by Love Cedar Point Inc. I, therefore, assume all risks associated with Glamping or in any program or lesson provided by Love Cedar Point, Inc. even if they arise from the negligence of Love Cedar Point Inc, staff, the County, promoters, officials, advertisers, OTAs and property owners. My participation in glamping is voluntary and no one is forcing me to participate in spite of the risks. I understand this waiver’s effect and risk acceptance on my legal rights. By reserving this release of liability and participating in any glamping, outdoor activity, program or lesson provided by Love Cedar Point Inc., I hereby fully and forever release and discharge indemnify and hold harmless Love Cedar Point Inc., their staff the County and their employees and agents, from any and all liabilities, claims, demands, damages, rights of action, suits or causes of action present of future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of my participation of said glamping and programs and lessons and use or intended use of said equipment. I fully and forever release and discharge Love Cedar Point Inc., its staff, and their employees and agents from any and all negligent acts and omissions in the same, and intend to be legally bound by this release.
